Carney’s Hate Law Rings Hollow After Recognition of Palestinian State

Canada has rolled out the Combatting Hate Act, a sweeping proposal meant to crack down on hate propaganda, threatening symbols and intimidation around religious and cultural spaces. The government says it is about protecting communities. Jewish Canadians who have watched Hamas flags waving in downtown streets and antisemitic chants shouted outside synagogues are asking whether this law will finally be enforced where it matters. It had it’s first reading in Parliament this week.

Justice Minister Sean Fraser introduced the bill with lofty words. “Canadians deserve to live freely in their communities, regardless of the colour of their skin, the god they pray to, or the person they love,” he declared. “Sadly, incidents of hate against entire communities have taken these freedoms from too many of our neighbours. This legislation strengthens protections against hate so Canadians … can feel safe in their communities and be free to celebrate their identities.”

The legislation removes the requirement for Attorney General consent before charges are laid in hate propaganda cases, meaning prosecutors can move faster. It also creates a new offence for displaying hate or terrorism symbols, and makes it illegal to obstruct or intimidate people entering synagogues, mosques, churches or cultural centres. It expands the definition of hate-motivated crime to cover almost any offence proven to be driven by hatred, with harsher penalties attached.

For many in the Jewish community, the promises sound familiar. After violent scenes in Toronto, where pro-Hamas demonstrators harassed Jewish residents, the Centre for Israel and Jewish Affairs, Friends of Simon Wiesenthal Center, B’nai Brith Canada and UJA Federation of Greater Toronto issued a blunt statement: “We condemn in the strongest terms these brazen acts of assault, intimidation, and hate targeting members of Toronto’s Jewish community and supporters of Israel. There is absolutely no justification for political violence in the streets of Toronto, whatever one’s cause may be. To put it bluntly: Those who hate Israel so much that it inspires them to egg and assault their fellow Canadians aren’t just a threat to Jews. They threaten the very fabric of Canadian society.”

Michael Mostyn, CEO of B’nai Brith Canada, did not mince words about recent protests: “Lines have been crossed.” Liberal MP Anthony Housefather went further, calling those same actions “not an expression of Canadian values. It is pure hate.”

But while Ottawa says the new law is a tool to protect targeted communities, legal experts are cautious. Joanna Baron, executive director of the Canadian Constitution Foundation, warned: “Creating new offences for hate-motivated crimes and lowering safeguards is unnecessary and invites excessive prosecutions.” Her colleague Josh Dehaas added: “The new hate symbol offence only targets displays done with the intent to promote hatred, but without Attorney General consent as a safeguard, there is a real risk that people using these symbols in art, journalism, or protest will be charged first and vindicated later.”

That leaves the central question hanging over the debate. The streets of Canadian cities have filled with Hamas flags, chants for violence, and mobs outside synagogues. Jewish schools and businesses have been targeted. With the Combatting Hate Act, Ottawa says it is ready to respond. The real test is not whether this law exists on paper but whether it will be used in practice. And now, with Prime Minister Mark Carney having just formally recognized a Palestinian state, the stakes could not be clearer. If prosecutors continue to look the other way while Hamas symbols and calls for Israel’s destruction scream across Canadian streets, then Carney’s government will stand accused of siding with those who incite hate instead of protecting the Jews of Canada.
